Degree of Relationship (Section 30 Order, Parental Order)

According to the law adopted under the Agreement on Assisted Fertilization and Embryology of 1990, married couples can be considered the legal parents of a child born to a surrogate by entering into an agreement with her.

According to this law, the transfer of a child to a married couple must be made within six months from the moment of his birth, and from that time he must live permanently in this family. Only after these conditions can a married couple apply to the court asking for a parental rights order for that child.

If the court is satisfied that the applicants are suitable parents and the transfer of the child has been carried out in an appropriate manner, it may make a parenting order. This gives the couple full parental rights over the child, as if it were born during their marriage. Thus, this law allows married couples to establish a legal connection with a child born by a surrogate mother.



The Degree of Relationship or Section 30 Order is a law that was enacted based on the Agreement on In Vitro Fertilization and Embryology, which was signed in 1990. This law defines the rules governing the relationship between married couples and the women who helped them become parents.

Under Section 30, married couples are considered the legal parents of any child born to a surrogate during pregnancy. This means that such couples are entitled to all the rights and responsibilities of parents, including the right to raise and care for the child.

The transfer of the child to the married couple occurs within six months after his birth. After this, the child must permanently reside in the family of his biological parents. If a child cannot live with his or her biological parents for any reason, they have the right to go to court to obtain a child custody order.

Section 30 also determines how property will be inherited if the child has no living parents. In this case, the child's closest relatives, including his brothers and sisters, grandparents, and other relatives specified in the will, will inherit the property.
